These Terms of Service ("Terms") are an agreement between you and ZG Vitality ("ZG Vitality," "we," "us"). They govern your use of www.zgvitality.com (the "Site") and any purchase you make from us. By using the Site or placing an order, you agree to these Terms and to our Privacy Policy, Refund Policy and Shipping Policy, which are part of these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to buy from us.

2. Products for Dogs Only; Not Veterinary Advice

Our products are nutritional supplements for dogs only. They are not intended to diagnose, treat, cure, mitigate or prevent any disease, and statements on the Site have not been evaluated by the Food and Drug Administration. Content on the Site is general educational information, not veterinary advice. You agree to consult a licensed veterinarian before giving any supplement to your dog, especially if your dog is pregnant, nursing, a puppy, has a medical condition or allergies, or takes medication. You also agree to follow the label directions and to stop use and contact your veterinarian if any adverse reaction occurs. Results vary from dog to dog. You are responsible for deciding whether a product is right for your dog.

3. Orders, Pricing and Payment

All orders are subject to acceptance and availability. Prices are in U.S. dollars and may change without notice. You pay the price shown at checkout. We may limit or cancel any order, including for suspected fraud, pricing or typographical errors, or an address we can't ship to. If we cancel an order after charging you, we will refund you. Applicable sales tax is collected at checkout.

4. Shipping

We currently ship only to addresses in Ohio, Illinois, Indiana, Kentucky, Michigan, Missouri, Pennsylvania, Tennessee, Virginia and West Virginia, and offer local delivery near our home base as described in our Shipping Policy. Title and risk of loss pass to you when we deliver your order to the carrier.

5. Returns and Refunds

Returns and refunds are governed by our Refund Policy, including our 30-day first-bag "Happy Dog" Guarantee.

6. Gift Cards

ZG Vitality digital gift cards never expire and carry no fees. They can be redeemed only on the Site, can't be exchanged for cash except where the law requires it, and can't be replaced if lost or used without your permission.

7. Reviews and Submissions

If you submit reviews, photos or other content, you give us a non-exclusive, royalty-free, perpetual license to use, reproduce and display it in connection with our business. You confirm that your content is truthful, is your own, and complies with the law. We may remove content at our discretion.

8. Intellectual Property

All Site content, including the ZG Vitality name, logos, formulas, text, images and designs, is owned by or licensed to us. You may not copy or use it without our written permission.

9. Disclaimer of Warranties

EXCEPT AS EXPRESSLY STATED IN THESE TERMS AND TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," AND WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT ANY PARTICULAR RESULT FROM USING ANY PRODUCT. Some jurisdictions do not allow these exclusions, so they may not apply to you.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER ZG VITALITY NOR ANY PERSON ACTING ON THEIR BEHALF WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATING TO THE SITE OR ANY PRODUCT. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT THAT GAVE RISE TO THE CLAIM. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for gross negligence or willful misconduct.

11. Indemnification

You agree to indemnify and hold harmless ZG Vitality from any claims arising out of your misuse of a product, your failure to follow label directions or veterinary advice, or your violation of these Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us first at ZGVitality@gmail.com and try in good faith to resolve the dispute informally for at least 30 days. Any claim that isn't resolved informally must be brought exclusively in the state or federal courts for Miami County, Ohio, and you consent to the jurisdiction of those courts. Either party may still bring an individual claim in small claims court. To the extent permitted by law, claims must be brought individually, not as a plaintiff or class member in any class or representative proceeding.

13. Changes

We may update these Terms by posting a revised version with a new "Last updated" date. Changes apply to orders placed after the revised Terms are posted.

14. Miscellaneous

If any provision of these Terms is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. These Terms are the entire agreement between you and us on their subject matter.
